＊形容詞用法の same が後ろの名詞を失ったと見做すことも出来、従って意味合いの違いは形容詞の用法同様に幾つかあります。

 関係代名詞の先行詞が  the  same を含む文

＊the same を名詞と一緒に使う場合、that を使った節を後に続けることができますが、who や which を使うことはあまりありません。

＊ that、 who、 which を省くこともよくあります。

＊要するにこの場合の  that,  who,  which  は目的用法の関係代名詞です。

＊先行詞としての the same + noun を限定する用法ですので、異なる者や物を比較して〜と同じだ、との意識はありません。そのものズバリの同一物、同一人です。
